Terms of Service
Draft — last edited alongside the site build
These terms govern your use of apexrail.co.uk and the ApexRail Connect application (together, the "Service"), operated by ApexRail Ltd. By using the Service you agree to these terms.
Using the website
The content on apexrail.co.uk is provided for general information about ApexRail's recruitment and labour supply services. You may browse it and submit enquiries through the contact and careers forms in good faith.
Using ApexRail Connect
- Accounts are for the individual named on them and must not be shared.
- Check-in and check-out records must be accurate. Confirming the safety briefing acknowledgment when it does not reflect reality is a serious matter and may result in account suspension.
- Administrators may access, edit, and manage worker records for the crew or site they are responsible for.
- We may suspend or remove accounts that are used to submit false attendance records, attempt unauthorised access, or otherwise misuse the Service.
No guarantee of employment
Use of the website or ApexRail Connect does not itself constitute an offer of work, a contract of employment, or a guarantee of placement. Specific terms for labour supply, contract, or permanent placements are set out separately in the relevant engagement documents.
Availability
We aim to keep the Service available but do not guarantee uninterrupted access. Planned or emergency maintenance may cause temporary downtime. ApexRail Connect includes offline queueing for check-in/check-out so brief connectivity loss on site does not block a safety check-in — see the app for details.
Liability
The Service is provided "as is". To the extent permitted by law, ApexRail is not liable for indirect or consequential loss arising from use of the Service. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, where such limitation is not permitted by law. [This section in particular needs solicitor review.]
Changes
We may update these terms from time to time. Continued use of the Service after a change constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of England and Wales. [Confirm jurisdiction with your solicitor if ApexRail operates elsewhere in the UK.]
